Dental Malpractice/fraud?

About 9 months ago I went to new dentist for a routine checkup. He told me I had several “superficial” cavities on my enamel & began drilling away. He administered novocaine, but I still felt intense pain during the drilling. He kept giving me more novocaine (4 vials for one area) but I still felt everything he did. He insisted I couldn’t possibly be feeling anything & continued drilling. After 2 excruciating appointments, he had managed to painfully drill into every molar & wisdom tooth in my mouth. It should be noted that during this time I was a Medicaid recipient. About 5 months later, I noticed one of my composite fillings had fallen out. I went to another dentist & it was discovered that besides the one filling falling out, 2 more were leaking & as a result, deeper cavities had formed. I had them replaced with amalgam & I never felt a thing after this dentist administered the novocaine. The dentist also commented on how many fillings the last dentist had done. Now, 9 months after the fact, another filling from the first dentist has fallen out & I’m absolutely dreading having to keep getting these fillings replaced that are less than a year old. I suspect the first dentist may have filled teeth that were otherwise healthy to bill medicaid & he obviously did a lousy job administering novocaine/fillings. Should I report him? Take legal action?

    THIS ABUSE SHOULD BE REGISTERED WITH YOUR STATE’S BOARD OF PROFESSIONAL REGULATION.
    THIS WAY IT REMAINS ON THE BOOKS FOREVER. THERE IS NO WAY TO REMOVE THIS OFFICIAL, LEGAL COMPLAINT.
    AS FAR AS LEGAL ACTION AGAINST THIS DENTIST- YOU CAN’T WIN IN A SUIT.

    How horribly sad, but in reality I suppose this happens. I personally would report it. I don’t know what any government office or agency would do and who knows, maybe this dentist has done it to others and your complaint would be enough to do something about him.
    Years ago my husband was on medicaide and hence he had more than just a few teeth pulled that could have been fixed. The dentist doing the work did not want to put the extra work into fixing the teeth so he pulled them. Very sad that this happened and sounds like it may still be happening.

    I absolutely think you should.
    I’m not sure how the legal process on such a thing really works, but I know that there are lots of malpractice lawyers that do free consultations. You could go for a first visit with a lawyer, see what he thinks of your case, and act from there.

    Did you have a copy of your xrays sent to the new dentist? If so, he would have noticed if the teeth were filled unnecessarily…
    You can file a complaint, just make sure it’s justified and you have proof of malpractice…………and insurance fraud.

    Absolutely! He should not have continued working when you said you could feel pain, that is not right. (Although I don’t know why you didn’t get up and insist he stop– I would have).

    There are many dentist and doctors out there that abuse medicaid. As to why you did not get numb could be a number of reasons…one being your particular metabolism on that day. Also likely that either your last dentist used a different anesthetic, or else that your last dentist used a different anesthetic technique on you, like a Gow-Gates or Akinosi nerve block. Your dentist shouldn’t proceed unless your lip is numb to the midline.
    You can report him to the ADA (American Dental Association) at http://www.ada.org. There are also state dental associations. You can google those for your state…. “Your state” Dental Association. You can also go to an attorney and get his advice. The attorney can request a copy of your billing account and see if this doctor committed medicaid fraud through over billing or billing for work not done. Plus advise you if you have any legal rights. My recommendation is do not get an “ambulance chaser” attorney. Get a reputable one who has good standing with your state bar and in your community. You can also google your attorneys state bar association. “Your State” bar association. Be sure you find one who specializes in litigation and medical malpractice.
