Would I Be Able To Take This Lawsuit To Court Or Would It Not Be Worth It (dental Malpractice)?
ok the insurance approved for my dentist to do a root canal on me, it was not hurting or anything , she ignored the other teeth that were hurting so bad that I had to call 911 from the pain, and why she did a root canal on that painless apparently healthy tooth is beyond my comprehension, as a result there is a tooth a waiting a crown and she is demanding $1,200 dollars for the crown to be put on without telling me this would be a result. I went in for treatment of the decayed teeth ( exctractions on the ones that hurt so bad i had to call 911, not for her to ignore those and then cut off the tip of a healthier panless tooth that costs $1,200 to fix) as if she was daingling a carrot in front of me, and she also drilled and shaved off some other teeth just because she felt like it, not for any benefit to anyone, she goes “hmmm shave that off a bit”
so what can I do? I feel violated. And worried.

Call the American Dental Association or the Dental Licencing Board where you live and discuss this with them.
Are you a dentist? I would assume that even if the tooth does not hurt, the “dentist” can still tell that it will be a problem soon. You were there to get teeth pulled, and she was trying to save one of your teeth so you would not have to get it pulled, and have a fake one put in. Which is more than 1200. If you have decayed teeth, maybe she was trying to get rid of all the decay. Just because it does not hurt, does not mean that it is not decaying. You don’t have a case, she did not do anything wrong. Sounds like you don’t want to pay her because she did not explain what she was doing. This is wrong on her part, but you will not prove it.
Hi Malpractice patient
Be wary the advice above from dentists, their lawyers and dento-legal advisors, etc etc etc- as it is probably not in your best interests- you’ll find if you watch carefully the ADA and dental boards and councils in most states will only report your case to insurance companies/ medical defence organisations in order to monitor malpractice (‘limit or minimise risk’ is their term) and make very sure you, the patient, doesn’t get any compensation. (MDOs/ insurers are obstructing justice through fraud, racketeering and collusion by falsifying records and x-rays, among many things, to remove real evidence or plant their own false evidence).
This bad dentist hasn’t informed you of the dental treatment she was going to perform and may have committed trespass/ assault and battery. Now the problem you have is also finding a law firm / personal injury lawyer that doesn’t collude with insurance companies for kickbacks – I don’t know of any, except possibly in Washington State or wherever (if any?) tort medical malpractice laws still protect patients’ rights to some extent. State governments, the American Dental Association, dental boards, law firms etc are all part of the same system where tort laws are favouring special-interest groups and it’s very important that their secret processes remain secret from the public.
Basically, you could be screwed, but telling the ADA, certain law firms, dental baords etc could screw you even further…Watch your back and record everything on an MP3 player or better, on secret video if you can take a friend in with you. Gather evidence quietly without lawyers knowing, dental boards and dentists knowing… that you are a malpractice patient. If you research what other malpractice patients have done in the US, UK, Australia, South Africa etc etc to avoid insurance companies/ MDOs tracking them, you might find a way…Good luck
